These Terms of Service govern your use of the Beyond Cards & Collectibles website and your purchase of products from us. By accessing our website, placing an order, or otherwise using our services, you agree to these Terms.

Throughout these Terms, “Beyond Cards & Collectibles,” “Beyond,” “we,” “us,” and “our” refer to Beyond Cards & Collectibles.

Our online store is hosted by Shopify, which provides the ecommerce platform that allows us to offer products and services to you.

1. Online Store Terms

By using this website or making a purchase, you represent that you are legally able to enter into a binding agreement or that you are using the website with the permission of a parent or legal guardian where required.

You may not use our products or services for any unlawful or unauthorized purpose or violate any applicable laws in connection with your use of the website.

2. Products and Collectibles

Beyond Cards & Collectibles sells trading cards, sealed trading card products, sports cards, collectibles, and related merchandise.

Trading cards and collectibles can experience rapid and significant changes in market value. Prices may increase or decrease after an order is placed. A subsequent change in market value does not change the agreed purchase price or create a right to cancel or return an order.

Unless otherwise stated, purchases of trading cards and collectibles are subject to our Return & Refund Policy.

3. Product Information

We make reasonable efforts to accurately describe and display our products.

Product photographs, packaging, colors, and other visual details may appear differently depending on lighting, photography, manufacturer changes, your device, or other factors.

For products represented by stock or manufacturer images, packaging or minor cosmetic details may differ from the image shown.

For individual cards or other items where the specific item pictured is material to the listing, we will make reasonable efforts to provide accurate photographs and descriptions.

Please review product titles, descriptions, photos, quantities, language, edition, configuration, and other relevant information before completing your purchase.

4. Sealed Trading Card Products

Factory-sealed products may contain randomly inserted cards or other contents determined entirely by the manufacturer.

Beyond Cards & Collectibles does not guarantee:

• Particular cards, players, characters, inserts, parallels, autographs, memorabilia, or other contents

• Pull rates or odds unless expressly provided by the manufacturer

• The condition, centering, print quality, surface quality, or grading potential of cards contained inside sealed products

• Any particular grade from PSA, BGS, CGC, or another grading company

Manufacturing defects involving the contents of an opened sealed product may need to be addressed directly with the manufacturer.

5. Pricing

Prices are listed in U.S. dollars unless otherwise stated.

We reserve the right to change prices at any time before an order is placed.

Because trading cards and collectibles may fluctuate significantly in market value, prices may change frequently.

A price change after a valid order has been accepted does not ordinarily affect that order.

6. Pricing and Listing Errors

We make reasonable efforts to ensure that prices and product information are accurate. Occasionally, a pricing, inventory, description, technical, or listing error may occur.

If an item is listed at an obviously incorrect price or contains a material error, we reserve the right to correct the error and, when appropriate, cancel and refund the affected order.

We will not intentionally cancel an accepted order solely because the market value of the product increased after purchase.

7. Orders

Submitting an order does not necessarily constitute final acceptance of that order.

We reserve the right to refuse or cancel an order when reasonably necessary, including in cases involving:

• Suspected fraud or unauthorized payment

• Pricing or listing errors

• Inventory discrepancies

• Quantity limitations

• Shipping restrictions

• Violation of these Terms

• Other circumstances that make fulfillment impractical or unlawful

If we cancel a paid order, we will refund the applicable amount to the original payment method unless otherwise required or agreed.

8. Purchase Limits

We may impose quantity limits on certain products, releases, customers, households, addresses, or orders.

We may cancel or reduce orders that exceed stated purchase limits or that reasonably appear to be attempts to circumvent those limits.

9. Preorders and Presales

Products offered before their official release date may be identified as preorders, presales, or similar terms.

Release dates are established by manufacturers, distributors, licensors, and other third parties and may change.

We do not guarantee that a product will arrive or ship on an originally estimated release date.

Unless otherwise stated on the product page, preorder and presale orders are considered committed orders once placed and may not be canceled solely because:

• The market value of the product changes

• The product becomes available elsewhere at a different price

• The manufacturer's release date changes

If we are unable to fulfill an item, we will provide an appropriate refund for the unfulfilled portion of the order.

10. Payment

You agree to provide current, complete, and accurate billing and payment information.

You represent that you are authorized to use the payment method submitted with your order.

Payment processing may be provided by Shopify or other third-party payment processors and may be subject to their own terms and policies.

11. Taxes

Applicable sales taxes and other legally required charges may be calculated and collected at checkout.

Customers are responsible for any taxes, duties, customs charges, or other governmental assessments that apply to their purchase unless we are legally responsible for collecting them.

12. Shipping

Orders requiring shipment are subject to our Shipping Policy.

You are responsible for providing an accurate and deliverable shipping address.

Please contact us as soon as possible if you discover an address error. We cannot guarantee that an address can be changed after an order has entered processing or shipment.

Shipping estimates are estimates and are not guaranteed delivery dates unless expressly stated otherwise.

13. Local Pickup

Products designated as eligible for local pickup may be collected at our Sebastopol location after you receive confirmation that the order is ready.

Please do not assume that an online order is ready for pickup until you have received a pickup notification or other confirmation from us.

We may request reasonable identification or order information when releasing a pickup order.

14. Returns and Refunds

Returns, exchanges, cancellations, and refunds are governed by our Return & Refund Policy, which is incorporated into these Terms by reference.

Because of the nature of trading cards and collectibles, most sales are final unless otherwise stated or required by law.

15. Third-Party Services and Links

Our website may contain links to third-party websites or use third-party services, including Shopify, payment processors, shipping carriers, social media platforms, mapping services, and other providers.

We are not responsible for the content, availability, practices, or policies of third-party websites and services.

Your use of those services may be governed by separate terms and privacy policies.

Unless otherwise stated, the Beyond Cards & Collectibles name, logo, website design, original written content, photographs owned by us, and other original materials on this website may not be copied, reproduced, republished, distributed, or commercially used without our permission.

Product names, logos, characters, trademarks, and other intellectual property belonging to Pokémon, Bandai, Wizards of the Coast, Topps, Panini, sports leagues, manufacturers, licensors, and other third parties remain the property of their respective owners.

Beyond Cards & Collectibles is not affiliated with or endorsed by those third parties unless expressly stated.

17. Prohibited Uses

You may not use the website or its content:

• For unlawful purposes

• To commit or facilitate fraud

• To interfere with website security or functionality

• To transmit malicious code

• To scrape or collect information in violation of applicable law

• To impersonate another person or provide fraudulent information

Inventory availability may change rapidly, particularly for limited-release trading card products.

Manufacturer warranties, if any, are provided by the applicable manufacturer and not by Beyond Cards & Collectibles unless expressly stated otherwise.

To the fullest extent permitted by applicable law, Beyond Cards & Collectibles will not be liable for indirect, incidental, special, consequential, or similar damages arising from your use of the website or purchase of products.

Nothing in these Terms limits liability that cannot legally be limited or excluded.
